In one paragraph. DecisionLab supplies calculation software: branded copies of its calculators and a printable client summary. It does not give financial product advice, credit assistance or tax agent services. The tools are generic, they never name or promote a specific financial product, and whatever you say to a client while using them is covered by your licence, not ours. You pay a one-off build fee and a monthly licence; we keep the numbers current; either of us can end the licence with a month's notice.
"DecisionLab", "we" and "us" means the operator of decisionlab.com.au. "You" means the firm named on the order confirmation email and anyone using the tools on its behalf. The order confirmation email, these terms and the invoice together form the agreement. The email may set scope, price and dates; it cannot vary clauses 3, 4, 5, 9 or 10.
We are not an Australian financial services licensee, credit licensee or registered tax agent, and we do not provide financial product advice, credit assistance or tax advice, general or personal. The tools produce numerical estimates from the inputs entered. They do not consider anyone's objectives, financial situation or needs, and they are not intended to be relied on for a decision about a financial product. Each tool says so on its face and on every client summary, and that wording must stay.
Every tool states its assumptions, its limitations and the date its rates were last checked against the source: the ATO, Services Australia, the Fair Work Commission or the relevant state revenue office. Where a result is an amount two or more years in the future, the tool also states its value in today's dollars. Superannuation projections follow ASIC Regulatory Guide 276 and ASIC Instrument 2022/603 by default (today's dollars at 3.7% a year in the accumulation phase and 2.5% a year in retirement, retirement age 67, contribution caps and tax rates as legislated), and users can change any non-statutory assumption. We build the tools to meet the conditions of ASIC Corporations (Generic Calculators) Instrument 2026/41 and, for superannuation tools, Instrument 2022/603, and we keep a copy of each version for seven years.
Results are estimates. Actual outcomes depend on future returns, legislation and personal circumstances and will differ. If we find an error we correct it, record it in the tool's changelog and email you. We do not warrant that any projection will be achieved.
The build fee is for work done and is not refundable once the first version is delivered. The licence runs month to month. Either party may end it by email with at least one month's notice; the tools stay live until the end of the last paid month and are then taken down, and the embed code stops working. We may suspend the tools immediately if a licence invoice is more than 30 days overdue or if clause 4 is breached, and will tell you by email when we do.
The calculation methods, code and design of the tools remain ours. You receive a non-exclusive licence to use the branded tools with your clients and on your website while the licence fee is paid. Your logo, name and brand assets remain yours. New calculators built at your request join the DecisionLab library unless exclusivity is agreed in writing for a separate fee.
The tools run in the user's browser. Inputs are not sent to or stored by DecisionLab. The hosted pages carry the same anonymous page-view analytics as the rest of the site, described in the Privacy Policy. Nothing a client types into a tool reaches us.
To the extent the law allows, our total liability under this agreement, however it arises, is limited to the fees you paid us in the twelve months before the event giving rise to the claim. We are not liable for indirect or consequential loss, or for any advice given, decision made or action taken by you or your clients using the tools. You agree to cover us against claims by third parties that arise from your advice, your clients' decisions or any change you make to a tool in breach of clause 4. Nothing in these terms excludes rights under the Australian Consumer Law that cannot be excluded; where a guarantee cannot be excluded, our liability is limited to re-supplying the service.
